1. Introduction and Agreement
These Terms of Service ("Terms") govern your access to and use of the website at hardmoneylenderspalmbeach.com and any related services (collectively, the "Site") operated by Lead Skills, LLC ("we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
2. Our Role: Lead Generation Service
The Site is a lead-generation service. We connect borrowers with one or more participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including loan approval, rates, terms, and funding timelines, are the responsibility of the participating lender. A current list of participating lenders is available upon request.
3. No Offer or Solicitation
Information on the Site is provided for general informational purposes and does not constitute an offer, solicitation, or commitment to lend, extend credit, or provide any financial product or service. Submitting an inquiry does not guarantee that you will be matched with a lender or that any lender will make an offer. All loan programs are subject to borrower and property qualification by the participating lender, and rates, terms, and conditions vary by lender and are subject to change without notice.
4. Eligibility
You must be at least 18 years of age and legally able to enter into a binding contract to use the Site. You agree to provide accurate, current, and complete information in any inquiry you submit, and to update that information as needed.
5. Your Consent to Be Contacted
By submitting an inquiry and checking the consent box on the form, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you.
Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply, and message frequency varies. You may opt out at any time by replying STOP to any text or by calling (561) 834-7695. A current list of participating lenders is available upon request.
6. Equal Opportunity
We connect borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.
7. Acceptable Use
- Do not use the Site for any unlawful, fraudulent, or abusive purpose.
- Do not submit false, misleading, or stolen information.
- Do not attempt to disrupt, interfere with, or gain unauthorized access to the Site, its systems, or other users' data.
- Do not copy, scrape, reverse engineer, or make commercial use of Site content without our prior written permission.
8. Intellectual Property
The Site and its content — including text, graphics, logos, trademarks, images, and software — are owned by or licensed to Lead Skills, LLC and are protected by applicable intellectual property laws. Except for limited personal, non-commercial use of the Site, no rights are granted to you.
9. Third-Party Links and Services
The Site may link to or reference third-party websites or services, including participating lenders. We do not control and are not responsible for the content, privacy practices, or conduct of any third party. Your interactions with any third-party service, including any participating lender, are solely between you and that third party.
10. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INQUIRY WILL RESULT IN A MATCH, CONTACT, OR LOAN OFFER FROM ANY PARTICIPATING LENDER.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY INTERACTION WITH A PARTICIPATING LENDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
12. Indemnification
You agree to defend, indemnify, and hold harmless Lead Skills, LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Site after an update constitutes acceptance of the revised Terms.
